Arquette wants Howard Stern as 'DWTS' coach

David Arquette has already demonstrated that he enjoys consulting Howard Stern whenever he comes to a crossroads in life. And his decision to do "Dancing With the Stars" was no exception!

"One of my first calls when I was considering it was to Howard," the actor told Sirius-XM's Howard 100 News today. "I asked him, 'What do you think?' They asked me last season too, and he said, 'I think it would be a good opportunity for people to get to know you better,' and that was one of my deciding factors."

And Arquette is hoping that the teamwork doesn't end there.

"I want him to be my backstage coach," he said, "to just help me out if he has any pointers, if he thinks I should focus on something, or what I'm doing wrong and sort of be part of the whole competition."

Stern, who's a big-time "DWTS" fan but has balked at wife Beth Ostrosky Stern joining the show because of all the time she would have to spend away from him, has proved to be one of Arquette's more stalwart supporters and we look forward to hearing what he has to say when he and his morning-show crew return from vacation.

How do 'Dancing' stars stack up?

The shock jock isn't the only opinionated person whom Arquette sought out, however.

Arquette also told E! News' Ryan Seacrest today that he asked daughter Coco what she thought of daddy doing "Dancing With the Stars."

"And she said, 'Initially, my feeling is no, but let me go to school and talk it over with my friend Ashley,'" he said, laughing. "I said, 'Wait, you can't talk about it with Ashley, it's a pretty big secret.'"

But apparently Coco came around (and maybe even Ashley approved) and now Arquette's just really excited to be a part of "DWTS."

"I love dancing, I've always loved dancing, and it's something that is such a...positive way of having a good time," said the separated "Scream" star. "That was a major part of it, an opportunity for people to get to know me without preconceived notions about who I am."

"I haven't thought too far along that line," Arquette said, when asked who the toughest competition appeared to be so far. "But I definitely want to win, you know. I'm a competitive person, but I just love the people that are on the show and I look forward to getting to know them better."

And if he has to get spray-tanned, so be it.

"I want to sparkle! I love glistening!" Arquette exclaimed. But "I don't want to get too orange."

Online courses have become an accepted fact of college life. But more and more school districts are turning to Web-based learning for lower grade levels, especially as a way for struggling high school students to make up courses they?ve failed or missed. The online classes aren?t only for those who have fallen behind, though. Due to budget constraints, some schools are using them to offer advanced placement classes and expand elective offerings. For example, Reza Namin, the superintendent of schools in Westbrook, Maine, told the New York Times that, while she couldn?t justify paying a Chinese language instructor in the face of a $6.5 million budget deficit, she was able to continue offering the course by turning to the online, non-profit Virtual High School Global Consortium.

The increasing reliance on digital education programs has drawn criticism from teachers and unions who claim the shift towards online learning is purely budgetary and an effort to pay fewer teachers? salaries. The argument could gain particular traction in Idaho, where a recent bill raided a fund used to pay educators to purchase laptops for every student in the state. The U.S. Department of Education has also expressed skepticism, saying there is little ?scientific evidence of the effectiveness? of online classes for K-12 students.

Bird flu flies back into the news

Millions of ducks are flying south from Siberia this week, and some are carrying a virus that could lead to a resurgence of H5N1 bird flu in poultry ? and people ? across Eurasia.

"We're issuing an alert because we expect in the coming weeks to see the virus pop up in unexpected places across a wide area," says Jan Slingenbergh, head of the UN Food and Agriculture Organization's early warning system for animal diseases.

H5N1 has cost poultry farmers an estimated $20 billion so far. It has also infected 565 people, of whom 331 died. Virologists are trying to discover the mutations that could enable H5N1 to spread between people and go pandemic.

Dominant strain

The FAO is concerned about a strain of H5N1, called 2.3.2.1, which has been circulating for several years but is now emerging as dominant in birds in Asia.

It is no more virulent than previous strains but it is well adapted to many wild migratory species, so the virus has been carried to countries where H5N1 had been eliminated from poultry, including Bulgaria, Romania and Israel.

H5N1 outbreaks in poultry peaked in 2006, with 4000 across Eurasia and Africa. Extensive culling and vaccination quelled the virus, and by 2008 there were just 302 outbreaks. With the spread of 2.3.2.1, outbreaks are back on the rise. Some samples of the strain in China and Vietnam show its continuing evolution.

"The more cases you get in birds, the more it might spill over into humans," says Slingenbergh.

WASHINGTON (AP) ? The number of people who signed contracts to buy homes fell in July, further evidence that the depressed housing market remains a drag on the economy.

The National Association of Realtors said Monday that its index of sales agreements fell 1.3 percent in July to a reading of 89.7.

A reading of 100 is considered healthy by economists. The last time the index reached that level was in April 2010, the final month that buyers could qualify for a federal tax credit.

Contract signings are usually a reliable indicator of where the housing market is headed. There's typically a one- to two-month lag between a sales contract and a completed deal.

But the Realtors group says a growing number of buyers have cancelled contracts after appraisals showed the homes were worth less than they bid. A sale isn't final until a mortgage is closed.

Michael Gapen, director of U.S. economic research at Barclays Capital Research, said the high number of cancellations suggest "heightened uncertainty on the part of purchasers and tighter credit standards in mortgage finance."

Home loans are harder to come by. Many lenders are requiring 20 percent down payments and strong FICO credit scores to qualify.

Signings are still roughly 18 percent above the June 2010 reading of 75.9, the lowest figure since the housing market went bust more than four years ago.

Even though pending home sales rose in two of the past three months, that hasn't translated into increased sales.

The pace of sales for previously occupied homes is trailing last year's 4.91 million sold, the fewest since 1997. In a healthy economy, people buy roughly 6 million homes each year.

Sales of new homes fell in July for third straight month. This year is shaping up to be the worst for sales of new homes on records dating back to 1963.

Homes are the most affordable they've been in decades. But bargain prices and super-low mortgage rates have done little to boost sales. Economists say it could be years before the nation's housing market recovers.

The number of people signing home contracts rose in both May and June. But those increases did not make up for a huge drop-off in April, when signings fell more than 11 percent.

Contract signings fell across most of the country. July's index fell 0.8 percent in the Midwest, 2 percent in the Northeast and 4.8 percent in the South. It rose 3.6 percent in the West.

Home prices have risen for two straight months, according to the Standard & Poor's/Case-Shiller home-price index. A flurry of spring buyers has boosted sales. After adjusting for seasonal factors, such as spring buying, prices fell in 11 of 20 metro areas tracked by the index.

A report on June's home prices will be released Tuesday.

Another reason prices are stabilizing is because millions of foreclosures are in limbo. Many have been delayed until the government completes an investigation into improper practices by mortgage lenders. Once that probe is finished, banks will start seizing homes again and prices will likely fall again.

Analysts say the weakening job market and the uncertainty over foreclosures could lead to deeper price declines in the second half of the year. They estimate prices will fall another 5 to 10 percent by year's end.

Symptoms

The symptoms of bowel cancer are very similar to common complaints such as piles or irritable bowel syndrome. Blood in your stool may be a sign of cancer, but it can also indicate other conditions. He has taught trial advocacy as an adjunct professor at Texas Wesleyan University Law School and creative writing at Richland College in Dallas.

Mike is much in demand as a presenter at writers? conferences around the country, speaking on topics ranging from legal issues for writers and understanding publishing contracts to how to get published. He created and taught a seminar sponsored by the Dallas Bar?s Sports & Entertainment Law Section entitled Beyond Briefs: Other Forms of Fiction Writing for Lawyers, and he has presented at the State Bar?s Entertainment Law Institute. As a regular presenter at the Screenwriting Conference in Santa Fe, he has taught seminars on the art and craft of adapting source material into screenplays, teaching alongside his collaborator and former Air Force U-2 pilot-turned-New York Times-best-selling novelist Patrick A. Davis, whose novels Mike has adapted to screenplays. He was quoted extensively in Les Edgerton?s book Hooked: Write Fiction that Grabs Readers at Page One and Never Lets Them Go, published by Writer?s Digest Books in 2007 and re-released in 2009.

As a book writer, Mike collaborated with former ABC-TV anchorman Murphy Martin to write Martin?s memoir of his years in journalism, entitled Front Row Seat: A Veteran Reporter Relives the Four Decades That Reshaped America (Eakin Press). Mike is also an award-winning screenwriter, having been optioned multiple times. His short film adaptation of the award-winning novel Balaam Gimble?s Gumption was released in 2010.

I?m often approached by writers ? both screenwriters and book writers ? who want to know the legal pitfalls to look for when writing a true story.? At some point in the discussion, the question always comes up:? ?Can they sue me if I do X, Y, or Z??? The answer is always the same:? ?Anyone can sue you fo anything.?

Then comes what, to them, is the crux of the matter:? ?Can I win??? At that point, I usually advise that the first question was the important one, not the second.? Your goal as a writer is not to win a lawsuit; it?s to avoid getting sued in the first place.? It?s expensive to hire lawyers and defend lawsuits, and you can go broke ?winning? (with apologies to Charlie Sheen).

In the world of letters, you have to worry about everything from libel (defamation falls into two categories; libel is written defamation
and slander is spoken defamation) to invasion of privacy to copyright or
trademark infringement to infringing on someone?s right of publicity, ad infinitum.? There is no sure-fire potion to insulate yourself from being sued, but here are some suggestions on how to lessen the chances of a lawsuit:

1.? Ask yourself whether the book or screenplay you are writing has to be a true story.? If not, fictionalize it.? There?s nothing wrong with writing a story that is ?inspired by? or ?based upon? real events.? It won?t immunize you from litigation, but it at least adds a layer of protection.? If, when you?re finished, the story and the characters in it are still easily recognizable, you?ve got some more insulating to do.

2.? If it just has to be a true story, get as many permissions or ?releases? as you can from the people you?ll be writing about. Talk to a lawyer about what to include in the release, but cover your bases so no one can later say you didn?t have the right to include them in the book or screenplay.

3.? Don?t say bad things about real people. That sounds kind of simple, but it?s not, and is one of the reasons to fictionalize your story rather than tout it as being a true story.? Calling a real live person a crook or a liar, in print, is often a direct road to the courthouse.? But sometimes simply implying that a real live person is a crook or liar can also get you there.? Again, consult with a lawyer before saying anything in print that might lead to the descriptive term ?defendant? after your name.

4.? Be aware of other rights that people might have.? For instance, as a general rule in law, you can?t defame the dead.? That means that, once a person has deceased, their estate can?t sue you for defamation.? But some jurisdictions recognize other personal rights that survive the person?s death, such as the right of publicity, and the family members of the deceased person still have rights of their own even if they can?t sue on behalf of the deceased.

5.? When doing your research on a real event, whether historical or contemporary, make your research as broad as possible.? If there is only one book on the subject, you run the risk of being accused of copyright infringement if you write on the same subject and use that book as your sole source.? The more sources you use, the more you insulate yourself from liability.? Notice I didn?t say you insulate yourself from getting sued; just that you insulate yourself from liability.

This is certainly not an exhaustive discussion of the topic, nor is it intended to be, but I hope it gives a general idea of at least the kinds of legal pitfalls that lurk on the writing landscape.? And, of course, nothing I?ve said here should be construed as legal advice. Laws may vary from jurisdiction to jurisdiction, and you should always consult with your own attorney when addressing any of these issues.

King.

In the early 1960s, they wrote for and produced hits by many girl groups, including the Dixie Cups and the Shangri-Las, but later grew away from pop mainstream to fare such as ?Is That All There Is?? and then producing movies and theater, including a failed musical version of ?The Apprenticeship of Duddy Kravitz.?

Leiber & Stoller have been honored by the Rock and Roll Hall of Fame, Songwriters Hall of Fame and many other music organizations.
